In the U.S, there are laws to prevent young ones from being sexually exploited by older citizens. The laws are known as consent laws stipulate the necessary ages from when teenagers are deemed capable and lawfully accepted to engage in consent sexual activities. If the woman in a sexual relationship is older than the young man with an age difference of more than 4 years, then the woman could be accused of sexual assault and exploitation of the young boy. The reason is that the young boy has not attained the federally accepted age of 18 years for one to be deemed a mature person ready and capable of making decisions concerning sexual consent. In California, for example, people over the age of 21years, if found to be in sexual relationships with minors less than 18 years, are subjected to severe penalties and jail terms (West Virginia Foundation for Rape Information & Services, 2020). The laws would affect both male and female adult sexual offenders even if the victim consented since the laws clearly state that minors below 18 years are incapable of making the right decisions on sexual activity.
The woman, in this case, should be prosecuted for sexually assaulting the young boy even if he had consented. The woman can be prosecuted for unlawful sexual force since the sexual engagement with an underage minor is not legally justified. The consent-of-age laws state that the minimum age for one to be considered mature enough to make decisions on their own is 18 years. Any sexual relationship with someone less than that age is considered an assault on the victim and a violation of statutory law laws (Hyett, 2020). The young man, in this case, even though he consented to engage in sexual activities with a woman older than him, is still considered underage since he is less than 18 years old.
Even if the case changes to the man being older than the woman, my stand will not change. The reason is that all sexual activities of exploitation and assault on any young one, regardless of a boy or girl, are unlawful and illegal as per the state laws of consent-of-age.
